All bookings are made through Masi Ma Samui Villas (collectively “MSV”) acting as the agent for the property owners listed on the Company’s website or through other platforms. Payment of a booking deposit will be deemed as confirmation of acceptance under the following terms and conditions.
Upon confirmation of your booking, we will inform you of the villa price and the applicable deposit amount. Bookings are made on a first-come, first-served basis and are subject to a minimum number of nights based on the length of stay, unless otherwise stated in the booking confirmation. MSV reserves the right to refuse any booking request without giving any reason. All published rates and extra beds are subject to local and government taxes of 7% and 10% service charge.
The above rates do not include baggage charges, tips, telephone, fax and telegraph charges, car rentals, meals, soft drinks and/or liquor, personal effects, expenses paid to third parties and unnecessary cleaning when departing (such as upholstery or carpet cleaning) or repairs to damaged parts. Normal wear and tear is accepted.
● An initial deposit of thirty percent (30%) is required to confirm a booking, unless otherwise stated in the availability confirmation.
● During Christmas, New Year and Chinese New Year, a deposit of fifty percent (50%) of the villa rental fee is required to confirm a booking.
● Before the booking is confirmed and the contract comes into force, MSV reserves the right to increase or decrease the agreed price. MSV will not agree or accept any contract prior to receipt of payment.
● If MSV does not receive payment within 24 hours from the booking date, MSV reserves the right to cancel the booking request and allocate the villa to another guest.
● If the booking is cancelled, a cancellation fee as per paragraph 3 of this announcement will be charged.
● The balance must be paid at least thirty (30) days prior to the arrival date, unless otherwise stated on the booking confirmation.
● If bookings are made within thirty (30) days prior to the arrival date, full payment is required upon confirmation and prior to the arrival date.
● During Christmas, New Year and Chinese New Year, the balance must be paid sixty (60) days prior to the arrival date, unless otherwise stated on the booking confirmation.
Payment can be made by international wire transfer, less bank fees, or using MSV's online payment gateway (a 3% processing fee (inclusive of 7% VAT) will apply to cards issued in the US and transactions located in the US). If paid by bank transfer, a scanned copy of the bank transfer or payment confirmation is required. For the avoidance of doubt, all bank and handling fees are the responsibility of the customer. If the balance is not received by the due date, MSV reserves the right to cancel the reservation and a cancellation fee as per paragraph 3 will be charged. If the reservation is confirmed within thirty (30) days prior to the arrival date, the full villa rental fee is required at the time of booking and prior to arrival.
Should a guest need to cancel any or all of the booking, such cancellation must be notified to MSV in advance in writing (email is acceptable). Cancellation will be effective from the date of receipt of written confirmation from MSV. Cancellation fees will be charged as follows, depending on the time MSV receives the written cancellation notice and the length of the guest’s stay in the villa:
● If cancelled 60 days or more prior to the departure date, a 20% rental fee will be charged.
● If cancelled 31 to 59 days prior to the departure date,
a 50% rental fee will be charged.
● If cancelled 30 days or more prior to the departure date, a 100% rental fee will be charged.
● Full or partial refunds are at the discretion of MSV and are only available if MSV arranges another booking to cover part or all of the original cancelled booking. Christmas and New Year Period:
● In the event of cancellation after the deposit and/or balance payment has been paid, the entire payment will be forfeited and a full or partial refund will only be available if MSV arranges another booking to cover part or all of the original cancelled booking.
A USD50 handling fee will be charged in case of refunds and booking modifications. The above cancellation fee will also apply if MSV cancels a booking due to non-payment of the remaining balance. If a booking date needs to be changed or modified, it may be considered a cancellation of the original booking and may be subject to a cancellation fee. Any changes to the original booking must be approved by MSV. Early departure penalty fees are subject to negotiation with MSV's local agent manager.
Guests are required to check in at 3:00 PM and check out at 11:00 AM. Early arrival or late check-out is subject to villa availability at the time of arrival or check-out. Additional charges may apply and will be advised at the time of booking. Guests must provide correct arrival details (flight number) whenever airport transfers are requested as part of the booking.
Although MSV is unlikely to be required to change the confirmed arrangements, this may happen from time to time and MSV will notify the Client as soon as possible. If there is any reason beyond MSV’s control which may result in MSV being unable to provide the booked villa to the Guest, MSV reserves the right to cancel the booking. For example, if a property is damaged or becomes unusable, MSV will endeavour to move the Guest to another property within the agreed time frame, but there is no guarantee that this will be possible. In the event that this is not possible or if the Guest does not wish to move, MSV will cancel the booking and refund the full amount paid to MSV for the villa, less any bank transfer fees. MSV shall not be liable for any further obligations or claims by the Guest or Client.
● Only the persons specified on the booking form may stay at the property as guests. Please inform MSV as soon as possible of any changes. The number of guests staying at the property, including children, must not exceed the maximum occupancy stated in the property description or elsewhere, except in the case of infants (under 2 years of age) or unless specifically permitted.
● If the owner or local agent finds that the number of guests staying at the property exceeds the number specified on the booking form or the maximum occupancy of the villa, the owner or local agent may request that the additional person pay an additional fee at the published rate or vacate the property, at the discretion of MSV.
● Tents are not permitted on the property.
● Pets are not allowed on the entire property.
● If a party is to be held at the hotel for more than 1.5 times the villa's maximum occupancy, this must be agreed upon prior to booking, as some villas have restrictions on the number of events permitted and the number of guests permitted.
● To be approved for the event, the full stay and minimum number of nights must be paid, and additional terms and conditions of the event must be agreed upon.
● In addition, a deposit will be collected by international wire transfer or cash on site, which may then be deducted from a cleaning fee before being returned to the guest.
A security deposit may be required to be paid to MSV upon payment of the remaining balance or prior to arrival at the villa. This deposit is used to cover damages or defects during the rental period of the villa or its contents. The deposit may also be used to cover telephone and other service charges. Failure to pay the full amount of the deposit may result in denial of access to the villa. The deposit is generally refundable at the end of the rental period, after deducting the cost of replacement or repair for any loss or damage to the villa or its surroundings or contents occurring during the rental period. The cost of replacement for any loss or damage to the villa or its surroundings or contents will be based on the property inventory value determined by MSV or the owner or owner's agent. If this cost cannot be reasonably determined prior to the guest's departure, MSV or the owner or owner's agent reserves the right to deduct the security deposit from a reasonable valuation and return the remaining balance to the guest as soon as possible after the actual cost has been determined. If the cost of replacement or repair for any loss or damage to the villa or its surroundings or contents occurring during the rental period exceeds the security deposit amount, the guest will be responsible for all remaining costs.
I/We agree to the above terms and conditions and agree that the above terms and conditions will apply to our booking.
Each villa has its own standard, quality and decoration, and also has its own style and decoration. The property descriptions provided by MSV on the website and elsewhere are provided in good faith. MSV is not responsible for any modifications not stated on the website or elsewhere. MSV, the villa owner and/or the local agent cannot be held responsible for any failure of water, electricity, internet connection or pool filtration system, although MSV will make every effort to resolve such problems promptly. Should there be any problems during the rental period that cannot be resolved by contacting the local villa staff directly, the guest may immediately contact MSV or the local agent and MSV will make every effort to rectify such situation. It is understood that local infrastructure, standards and environment are often less developed in remote resorts than in urban environments. MSV will make every effort to avoid and rectify any problems that may arise, but will not be responsible for any problems beyond its control. MSV must notify MSV or the local agent of any complaints within 24 hours of the occurrence of the event giving rise to the complaint and must notify MSV in writing before departure. If the problems reported are not resolved, please notify MSV in writing within 14 days from the end of the rental period. If the villa is moved out before the end of the rental period without mutual agreement This may result in the loss of all rights to compensation. No claim will be considered if filed after the departure date or without the consent of the MSV Villa Owner or Local Agent.
The person paying the villa rental deposit is responsible for the proper and appropriate behavior of the guests staying at the villa, including visitors to the villa, throughout the rental period. If any member of the group behaves in a manner deemed inappropriate, MSV, the villa owner or the local agent may ask the offending guest or group of guests to leave the villa immediately at its absolute discretion. In such case, the original booking will be considered as cancelled and no refund will be claimed from MSV, the villa owner or the local agent.
Any illegal activity and the import and/or use/consumption of illegal substances are prohibited. Violators will be taken to the local authorities. In addition, in line with moral obligations and respect for local employees, as well as for the safety of our valued guests, guests are not allowed to bring back any person found on the premises to the property under any circumstances. The local manager reserves the right to ask such person to leave the property at any time.
Some types of staff will be available at the villa (e.g. villa manager, housekeeper, maintenance man, Thai chef). Additional services such as babysitters and/or drivers can be requested in advance or at the villa, but these services cannot be guaranteed and are subject to availability. Should additional services be requested, guests are advised to inform us as early as possible, especially during holiday periods. MSV or local agent will do its best to accommodate and accommodate requested services once notified. MSV or local agent will not be responsible for such contracted staff. These rates are to be provided in advance and must be paid directly to the Guest Relations Manager.
Bed linens and towels are provided at the villas and are typically changed every five (5) days. If guests require them to be changed more frequently, an additional fee will apply. Laundry facilities are limited on site and are charged as listed. On-site laundry services are also available for a service fee. Charges must be paid at the time of occurrence or no later than the time of departure.
All villas are equipped with a personal safe. Guests are advised to keep valuables in the safe such as passports, personal documents, laptops, cash, traveler's checks, mobile phones, cameras, etc. Any valuables left on the premises are the sole responsibility of the guests. Neither MSV, the owners nor the staff will be held liable for any loss or damage of personal property. Guests are advised to ensure that all doors and windows are locked at night to avoid any disturbances.
Guests must take extra care when staying in the villa and should be aware of children playing in the garden, near the entrance from the main road, near or in the swimming pool or Jacuzzi, on the beach or in the sea. Additionally, guests or their parties will not be permitted to enter the villa when wet from swimming, as the floors may be slippery. Any damage or injury caused by MSV will not be the responsibility of the villa owner or the local agent under any circumstances.
The Customer and/or Guest acknowledge and agree that personal data (e.g. name, age, contact details, credit card details) provided to MSV will be collected and used for all or part of the following purposes:
● Comply with its obligations during or in connection with the provisions under this Agreement
● Verify the identity of the Customer and/or Guest
● Respond to, handle and process inquiries, requests, applications, complaints and comments from the Customer and/or Guest
●
Process payment or credit transactions
●
Comply with applicable laws and regulations or to assist in law enforcement and investigations conducted by governmental and/or regulatory authorities
● Legitimate and public interests
● Any other purpose for which the Customer and/or Guest has provided information to MSV The Customer and/or Guest agrees that MSV may disclose its personal data for the following purposes:
● Where such disclosure is necessary to perform its obligations during or in connection with the provisions under this Agreement
● Legitimate and public interests
● Obligations to third party service providers, agents and other bodies as required by applicable law The consent of Customer and/or Guest to the collection, use and disclosure of Personal Data under this Agreement shall remain in effect until such consent is withdrawn by Customer and/or Guest in writing or twelve (12) months after the termination of these Terms and Conditions. Any request by Customer and/or Guest to MSV to cease using and/or disclosing Personal Data for any or all of the purposes stated above must be submitted to MSV in writing.
These Terms and Conditions and any applicable Contract shall be governed in all respects by the laws of Hong Kong and exclusively the courts of Thailand shall have exclusive jurisdiction over any claim or dispute arising out of or in connection with these Terms and Conditions.
